Terms and Conditions
These Terms and Conditions apply to all purchases, orders, quotes, custom work, deliveries, pickups, and services provided by Naked Furniture. By placing an order, paying a deposit, accepting a quote, or purchasing any product from Naked Furniture, the customer agrees to the terms below.
Product Information
Naked Furniture offers solid wood furniture, custom furniture, unfinished furniture, custom finishing, lighting, mattresses, accessories, and related products.
Because many of our products are made from natural solid wood and may be custom-sized, custom-stained, custom-finished, or specially ordered, variations in wood grain, colour, texture, knots, mineral marks, and natural character are expected. These natural features are not considered defects.
Quotes and Pricing
All quotes are based on the information available at the time the quote is prepared. Pricing may vary depending on wood species, size, finish, hardware, fabric, design changes, supplier pricing, freight costs, and other factors.
A quote does not secure pricing until the required deposit or full payment has been received and the order has been approved by Naked Furniture.
If an error appears on the website, in-store display, quote, invoice, catalogue, advertisement, or any written or verbal communication, Naked Furniture reserves the right to correct the error before accepting or completing the order.
Orders and Deposits
A deposit may be required to place an order. The deposit confirms the customer’s approval to proceed with the order based on the details shown on the invoice, quote, or order form.
It is the customer’s responsibility to carefully review all order details before approving the order, including product name, size, wood type, stain, finish, hardware, fabric, quantity, delivery address, and any custom instructions.
Once an order is placed, changes may not be possible. If changes are possible, they may result in additional charges, revised lead times, or both.
Custom Orders
Custom orders include, but are not limited to, custom sizes, custom stains, custom finishes, custom-built furniture, unfinished products prepared for a specific customer, special-order items, modified designs, and any product ordered specifically for the customer.
Because custom orders are made or prepared specifically for the customer, they are final sale and cannot be cancelled, refunded, exchanged, or returned.
Retention of Ownership
All merchandise remains the property of Naked Furniture until full payment has been received and cleared.
Naked Furniture is not required to release, deliver, install, or allow pickup of any merchandise until the order has been paid in full.
Payment Terms
Approved payment methods will be specified at the time of purchase. Personal cheques are not accepted.
Final payment must be made before delivery, pickup, release, or installation of the product unless otherwise approved in writing by Naked Furniture.
Naked Furniture reserves the right to change accepted payment methods at any time.
Final Sale Items
The following items are final sale and are not eligible for refund, exchange, return, or cancellation:
- Custom furniture
- Custom-finished products
- Custom-stained products
- Unfinished products
- Sale items
- Clearance items
- Floor models
- Mattresses
- Lighting products
- Special-order items
- Products that have been assembled, used, altered, installed, damaged, or delivered
Refunds, Exchanges, and Cancellations
All sales are final unless Naked Furniture agrees otherwise in writing.
Refunds, exchanges, or cancellations are not available on custom, unfinished, sale, clearance, lighting, mattress, floor model, or special-order items.
If Naked Furniture approves a return or exchange as an exception, the product must be unused, undamaged, unaltered, and in its original condition. Any approved return or exchange may be subject to restocking fees, delivery charges, pickup charges, repair costs, packaging costs, or other applicable fees.
Lighting Products
All lighting products are final sale and cannot be returned or exchanged.
If a part of a lighting product is damaged or defective, Naked Furniture may replace only the affected part, subject to supplier approval and part availability. Full product replacement is not guaranteed unless required by the supplier or manufacturer.
Mattresses
Mattresses are non-refundable and non-exchangeable for hygiene and safety reasons.
Floor Models and Clearance Items
Floor models, clearance items, discontinued items, and “as-is” products are sold in their current condition.
These items may have marks, scratches, dents, colour variation, finish variation, wear, missing packaging, or other imperfections. It is the customer’s responsibility to inspect these items before purchase, pickup, or delivery.
Floor models and clearance items are final sale and are not covered by standard warranty unless specifically stated in writing.
Lead Times and Delivery Dates
Estimated lead times and delivery dates are provided in good faith but are not guaranteed.
Delays may occur due to material availability, supplier delays, manufacturing schedules, finishing time, transportation delays, weather, labour issues, import delays, or other circumstances beyond the control of Naked Furniture.
A delay in production, shipping, finishing, or delivery does not give the customer the right to cancel the order, refuse delivery, or receive a refund.
Delivery Service
Naked Furniture may offer delivery services for an additional charge.
Before delivery, the customer is responsible for ensuring that the delivery path is clear and safe. This includes driveways, entrances, elevators, stairways, hallways, doorways, rooms, and any area where the delivery team must pass.
The customer must remove fragile items, artwork, mirrors, electronics, rugs, existing furniture, or other personal belongings from the delivery area before the delivery team arrives.
Naked Furniture is not responsible for moving existing furniture or personal belongings unless this service has been agreed to in advance.
Customer Responsibility for Fit
It is the customer’s responsibility to measure all spaces before placing an order. This includes room size, ceiling height, doorways, stairways, elevators, hallways, corners, landings, and any other access points.
Naked Furniture may provide general advice, but the final responsibility for ensuring that furniture fits into the home, room, elevator, stairway, or delivery path remains with the customer.
If the furniture does not fit, the customer is still responsible for full payment, delivery charges, return transportation, storage fees, modification fees, or any other related costs.
Pickup Orders
Customers who choose pickup are responsible for safe handling, loading, transportation, unloading, assembly, and protection of the furniture.
Customers must bring suitable vehicles, blankets, straps, padding, manpower, and any other equipment required to safely transport the furniture.
Once an item leaves Naked Furniture’s premises, the item is considered received in good condition unless damage was noted in writing before pickup.
Naked Furniture is not responsible for damage, injury, loss, or transportation issues after customer pickup.
Inspection Upon Delivery or Pickup
The customer or an authorized person must inspect all products at the time of delivery or pickup.
Any visible damage or concern must be reported immediately before the delivery team leaves or before the item is removed from Naked Furniture’s premises.
Failure to inspect the product at the time of delivery or pickup may limit Naked Furniture’s ability to assess or resolve the issue.
Storage
If a customer is not ready to receive or pick up an order when it is ready, Naked Furniture may, at its discretion, hold the item for a limited time.
Storage is not guaranteed and may be subject to storage fees.
Naked Furniture is not responsible for damage or changes caused by long-term storage, humidity, dryness, temperature changes, or delays caused by the customer.
All outstanding balances must be paid before any long-term storage arrangement is approved.
Solid Wood Characteristics
Solid wood is a natural material. Each piece is unique and may include natural grain patterns, knots, mineral streaks, color variation, texture variation, small checks, and other natural features.
Wood expands and contracts with changes in humidity, temperature, and seasonal conditions. These movements are normal and are not considered manufacturing defects.
The following are not considered defects:
- Natural grain variation
- Color variation between boards
- Knots or mineral marks
- Slight differences in stain absorption
- Expansion or contraction caused by humidity changes
- Minor movement in doors, drawers, table tops, or extensions
- Small seasonal gaps or alignment changes
- Differences between samples and finished products
Table Extensions and Leaves
Table leaves and extensions should be stored in the same or similar humidity and temperature conditions as the table.
Table leaves should not be stored in damp basements, garages, extremely dry rooms, or areas with major temperature or humidity changes.
Because solid wood expands and contracts, table leaves or extensions may not always remain perfectly level, flush, or identical in width to the main table top. This is a natural characteristic of solid wood and is not considered a defect.
Table extensions are intended for occasional use and should not be left in the table for extended periods unless recommended by Naked Furniture.
Furniture Care
The customer is responsible for the proper care and maintenance of the furniture.
To protect solid wood furniture, customers should:
- Maintain indoor humidity at a stable level, ideally around 40% to 45%
- Avoid direct sunlight
- Avoid placing hot, cold, or wet items directly on the furniture
- Use coasters, placemats, pads, and trivets
- Dust with a soft cloth following the grain
- Clean with a slightly damp cloth and dry immediately
- Avoid harsh cleaners, solvents, silicone-based polish, wax, or products such as Pledge
- Avoid dragging dishes, décor, or objects across the surface
Damage caused by improper care, humidity, dryness, water, heat, sunlight, chemicals, misuse, neglect, or environmental conditions is not covered by warranty.
Warranty
Naked Furniture offers a 5-year manufacturer warranty on qualifying furniture products.
This warranty applies to manufacturing defects in materials or workmanship under normal residential use and proper care. Warranty coverage will be assessed by Naked Furniture on a case-by-case basis.
The warranty does not cover:
- Natural wood characteristics
- Colour or grain variation
- Seasonal expansion or contraction
- Damage caused by humidity, dryness, or extreme temperature changes
- Damage caused by water, heat, sunlight, or chemicals
- Damage caused by improper cleaning or care
- Normal wear and tear
- Scratches, dents, chips, or impact damage
- Damage caused by customer pickup or third-party transportation
- Damage caused by incorrect assembly, installation, misuse, or modification
- Products altered, repaired, refinished, or modified by anyone other than Naked Furniture or an approved service provider
- Floor models, clearance items, or as-is products unless stated in writing
- Mattresses, lighting, hardware, accessories, or supplier products covered by separate manufacturer warranties
If a valid manufacturing defect is confirmed within the warranty period, Naked Furniture may, at its discretion, repair, replace, rework, refinish, or provide another suitable solution.
Refunds are not provided for natural wood movement, grain variation, color variation, or other natural characteristics of solid wood.
Repairs, Rework, and Service
If Naked Furniture agrees to inspect, repair, rework, re-stain, refinish, or rebuild an item, the customer may be responsible for transportation, pickup, delivery, packaging, labour, material, or service charges unless otherwise agreed in writing.
If a piece is reworked or repaired, the customer may be required to inspect and approve the item before redelivery or pickup.
Safety and Wall Attachment
It is the customer’s responsibility to safely install, secure, and use furniture in the home.
Tall furniture, cabinets, bookcases, dressers, wall units, and similar items may need to be attached to the wall for safety. The customer is responsible for securing furniture where necessary to reduce the risk of tipping, injury, or property damage.
Naked Furniture is not responsible for injuries, accidents, or damage caused by failure to secure furniture properly.
Website Information
Naked Furniture makes reasonable efforts to ensure that website information, images, prices, colors, sizes, product descriptions, and availability are accurate. However, errors may occur.
Product colors and finishes may appear differently depending on screen settings, lighting, wood species, grain, and stain absorption.
Naked Furniture reserves the right to correct errors, update information, change pricing, change product availability, or discontinue products at any time without notice.
Privacy and Customer Information
Naked Furniture respects customer privacy.
Customer information may be collected and used for order processing, payment, delivery, customer service, warranty support, marketing communication where permitted, and legal or accounting requirements.
Naked Furniture does not sell customer personal information. Personal information will not be shared with third parties except where necessary to complete an order, provide delivery or service, process payment, comply with legal obligations, or as otherwise permitted by law.
Customers may contact Naked Furniture to request access to, correction of, or deletion of their personal information, subject to legal and business record requirements.
Taxes, Duties, and Additional Charges
Applicable taxes, including HST, will be charged where required.
The customer is responsible for any additional charges related to delivery, shipping, storage, special handling, difficult access, parking, elevator booking, long-distance delivery, customs, duties, import fees, or other costs related to the order.
Limitation of Liability
To the maximum extent permitted by law, Naked Furniture is not responsible for indirect, incidental, special, or consequential damages, including loss of use, loss of enjoyment, delays, inconvenience, or costs related to replacing or arranging alternative furniture.
Naked Furniture’s responsibility for any claim shall not exceed the amount paid by the customer for the specific product or service giving rise to the claim.
Governing Law
These Terms and Conditions are governed by the laws of the Province of Ontario and the applicable laws of Canada.
Any dispute shall be handled in Ontario, unless otherwise required by law.
Changes to Terms and Conditions
Naked Furniture reserves the right to update or change these Terms and Conditions at any time.
The Terms and Conditions in effect at the time of purchase or order approval will apply to that order unless otherwise required by law.
